Section 01
Scope and Related Policies
These Terms of Service (the “Terms”) govern your access to and use of avensai.com and any purchase you make from Avensai. In these Terms, “Avensai,” “we,” “us,” and “our” refer to the operator of the Avensai online store, and “you” and “your” refer to the person using the website or purchasing from us.
By accessing the website, creating an account, or placing an order, you agree to these Terms and the policies referenced here. If you do not agree, please do not use the website or place an order.
The Services include the website, online store, content, and features made available by Avensai. Shopify provides the ecommerce platform, but it is not the seller of the products and is not a party to the purchase contract between you and Avensai.
If product-specific, promotional, or other written terms conflict with these Terms, the more specific terms apply to that product or promotion. Mandatory applicable law takes priority over any conflicting provision.
Section 02
Eligibility and Customer Accounts
You must be legally capable of entering into a binding contract where you live. If you are not, you may browse the website only with appropriate supervision, and any order must be submitted by a parent or legal guardian.
When creating an account or placing an order, you agree to provide current, complete, and accurate information. You are responsible for protecting your account credentials and for activity resulting from your failure to protect them, except to the extent the activity was caused by our act, omission, or security failure. Contact us promptly if you believe your account has been accessed without authorization.
We may suspend or restrict an account where reasonably necessary to address suspected fraud, unlawful activity, security risks, or a material breach of these Terms.
Section 03
Products and Availability
We make reasonable efforts to describe and display products accurately. However, colors and appearance may vary depending on your screen, device settings, lighting, and reasonable manufacturing variations. These variations do not limit rights you may have if a product is faulty or materially different from its description.
Products may be available in limited quantities. We may introduce, modify, limit, or discontinue products, and may limit quantities per customer or order, where lawful. Changes to products or prices do not affect an order that we have already accepted, except where we contact you about an evident error and provide an appropriate option to confirm or cancel the affected order.

Prices, Taxes, and Payment
Prices are displayed in the currency shown on the website. Product prices, applicable shipping charges, taxes collected at checkout, discounts, and the final order total are displayed before purchase.
Payment is processed through Shopify and the payment provider you select. By submitting payment details, you confirm that you are authorized to use the selected payment method and authorize the applicable provider to charge the amount shown at checkout.
If a price or product listing contains an evident error, we may contact you before fulfillment to offer the correct information and allow you to confirm or cancel the order. If we cancel an order after payment has been collected, we will refund the amount paid for the canceled portion to the original payment method.
Section 05
Orders, Acceptance, and Cancellations
Placing an order is an offer to purchase. An automated acknowledgement confirms that we received your order but does not necessarily mean that we have accepted it. Unless applicable law requires otherwise, we accept the order when we send an acceptance or dispatch confirmation.
Orders are subject to product availability, payment authorization, delivery restrictions, fraud and security checks, and applicable law.
We may decline or cancel an order for a valid reason, including unavailable inventory, an evident pricing or description error, failed payment authorization, suspected fraud, purchase limits, or legal restrictions. Where reasonably possible, we will notify you using the contact details supplied with the order. If payment has already been collected for a canceled order, we will issue a refund to the original payment method.
Orders that appear to be intended for unauthorized resale or commercial redistribution may be limited or canceled.
We accept cancellation requests before dispatch. Once an order has been dispatched, it can no longer be canceled and the applicable return process will apply. To request a change or cancellation, contact support@avensai.com as soon as possible.
Section 06
Shipping and Delivery
Orders generally require 1–3 business days to prepare before dispatch. After dispatch, standard shipping is estimated at 5–8 business days and express shipping at 3–5 business days. Processing and transit times are separate.
If we cannot dispatch within the stated 1–3 business-day processing period, we will notify you and offer the option to accept a revised dispatch date or cancel the affected order for a prompt full refund.
Available methods, charges, destination-specific information, tracking, and possible delays are displayed at checkout where applicable and described further in our Shipping Policy.
Delivery dates are estimates unless we expressly agree to a guaranteed date. Delays may occur because of customs processing, carrier disruptions, severe weather, public holidays, incorrect delivery information, or other events outside our reasonable control.
Nothing in this section limits any remedy available to you under applicable law for delayed or undelivered goods.
Section 07
Returns, Refunds, and Consumer Rights
Our return window is 14 days from delivery of the final item in your order, subject to the eligibility requirements, procedures, and permitted exclusions in our Return & Refund Policy. Please contact support@avensai.com before sending an item back so we can review the request and provide return instructions.
Our published return period is separate from rights that may arise under applicable law. Depending on where you live, you may have additional rights relating to withdrawal, cancellation, faulty goods, goods that are not as described, repair, replacement, price reduction, or refund.

Acceptable Use
You may use the Services only for lawful personal or authorized business purposes. You must not:
- violate applicable law or the rights of another person;
- infringe intellectual property, privacy, publicity, or other proprietary rights;
- submit false, deceptive, defamatory, abusive, discriminatory, obscene, or unlawful content;
- upload malware or code designed to damage, interrupt, monitor, or gain unauthorized access to systems or data;
- impersonate another person or misrepresent your identity or affiliation;
- collect personal information about others without authorization;
- spam, phish, scrape, crawl, probe, or circumvent security or access controls, except where expressly permitted by law; or
- interfere with the operation, security, or integrity of the Services.
We may restrict access where reasonably necessary to stop or investigate prohibited conduct.
Section 09
Intellectual Property
The website and its content—including text, graphics, photographs, designs, logos, product names, videos, software, and layout—are owned by or licensed to Avensai and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, sell, license, reverse engineer, or commercially exploit our content without prior written permission, except where applicable law expressly permits it.
Section 10
Reviews, Feedback, and User Content
If the Services allow you to submit a review, image, comment, suggestion, or other content (“User Content”), you retain ownership of that content and remain responsible for it. You must have the rights needed to provide it.
You grant Avensai a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt, publish, and use User Content in connection with operating, improving, and promoting the Services. This license lasts only for as long as reasonably necessary for those purposes, including reasonable archival and legal-compliance periods.
User Content must not be unlawful, misleading, infringing, abusive, or contain malware or another person’s personal information without authorization. We may moderate or remove User Content where reasonably necessary, but we are not required to monitor every submission.
Section 11
Third-Party Services and Links
The Services may use or link to tools, payment services, social platforms, applications, or websites operated by third parties. Those services are governed by the third party’s own terms and privacy notices.
We do not control third-party services and are not responsible for their independent acts or omissions. This does not limit any responsibility Avensai has under applicable law for the products or Services we provide to you.

Privacy and Personal Information
Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy. Shopify and other service providers may also process personal information as described in that policy and in their own applicable notices.
By placing an order, you agree to receive necessary transactional communications, including order confirmations, payment notices, shipping updates, policy notices, and customer-support messages. Marketing communications are sent only where permitted, and you may unsubscribe from them without affecting essential service messages.
Please do not send passwords, complete payment-card numbers, or other highly sensitive credentials to us by email.
Section 13
Accuracy and Service Availability
We make reasonable efforts to keep website information accurate and current. From time to time, information may contain typographical errors or inaccuracies relating to product descriptions, prices, promotions, availability, shipping charges, or delivery estimates.
We may correct errors and update information. If a correction materially affects an order you have placed, we will take reasonable steps to notify you and, where appropriate, offer the option to confirm the corrected order or receive a refund for the affected portion.
The website may occasionally be unavailable because of maintenance, technical problems, security issues, or events outside our reasonable control. We do not promise that every website feature will always be uninterrupted or error-free.

Warranties and Disclaimers
Products and Services are provided subject to the descriptions, express promises, statutory warranties, and consumer guarantees that apply to the transaction.
To the fullest extent permitted by law, we do not make additional warranties about uninterrupted website access or the accuracy of general informational content that is not part of a product description or contractual promise.
Nothing in these Terms excludes liability or responsibility for faulty goods, goods that are not as described, unsafe products, or any other matter for which liability cannot lawfully be excluded.
Section 15
Limitation of Liability
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, death or personal injury caused by negligence, breach of a mandatory consumer guarantee, or any other liability that cannot lawfully be excluded or limited.
If you are a consumer, we are responsible for losses that are a reasonably foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. To the fullest extent permitted by law, we are not responsible for losses that were not reasonably foreseeable, losses caused by your own breach, or business losses arising from a purchase made primarily for personal use.
Your statutory remedies remain available and are not replaced by this section.
Section 16
Events Outside Our Reasonable Control
We are not responsible for delay or failure caused by an event outside our reasonable control, such as natural disasters, severe weather, war, civil unrest, government action, customs disruption, labor disputes, carrier interruption, widespread telecommunications failure, or a major cybersecurity incident not caused by our failure to use reasonable care.
Where such an event affects an order, we will take reasonable steps to reduce the impact and communicate with you when practicable. Any cancellation or refund right required by applicable law remains available.
Section 17
Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary because of a material breach of these Terms, unlawful conduct, fraud, abuse, a security threat, or a legal requirement.
Where reasonable and legally permitted, we will provide notice and an opportunity to address the issue. Termination does not affect rights, obligations, payments, refunds, or liabilities that arose before termination. Provisions that by their nature should survive termination—including intellectual property, liability, and general legal provisions—will continue to apply.

Changes to These Terms
We may update these Terms to reflect changes to the Services, business practices, or legal requirements. The revised version will be posted on this page with a new “Last updated” date.
Material changes will apply prospectively. They will not retroactively change the terms governing an order already accepted unless required by law or expressly agreed with you. Where required, we will provide additional notice or obtain consent.
Section 19
General Legal Terms
If any provision of these Terms is found unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
If we delay enforcing a provision, that does not waive our right to enforce it later. These Terms and the policies incorporated into them form the agreement between you and Avensai regarding the Services, except for additional terms expressly agreed in writing.
These Terms are governed by applicable law. If you are a consumer, nothing in these Terms deprives you of mandatory protections available under the laws of your usual place of residence or of access to any court or dispute-resolution process available to you under applicable law.
